Welcome to GroomWave! These Terms of Use ("Terms") govern your access to and use of the GroomWave website and software (the "Service"), owned and operated by Gecko Grid (Pty) Ltd ("Company," "Gecko Grid," "we," "us," or "our"), a private company registered in the Republic of South Africa.
1. Description of Service & Eligibility
GroomWave is a client and booking management platform designed for pet groomers and mobile pet groomers. The Service allows you to manage clients, pets, bookings, recurring schedules, invoicing, and operational units/vehicles. By using the Service, you represent that you are at least 18 years of age or have legal parental consent.
2. Subscriptions & Billing
- Tiers: We offer Free, Pro, and Elite plans. Additional units/vehicles may require a higher-tier plan or add-on fee.
- Free Trial: New users may start on a Pro Trial. If no paid subscription is active at the end of the trial, the account will be automatically downgraded to the Free Tier.
- Merchant of Record: All payments are handled by Paddle. By subscribing, you agree to Paddle's terms.
- Refunds: Refund requests are handled according to our Refund Policy and Paddle's standard policies.
3. Fair Use & Prohibited Conduct
To ensure a high-quality experience for all users, you agree not to:
- Use bots, crawlers, or scripts to access or "scrape" the Service.
- Use GroomWave as a remote storage or file-hosting service for large, non-business-related files.
- Attempt to bypass any usage limits associated with your tier (e.g., creating multiple free accounts to circumvent plan restrictions).
- Use the Service for any illegal activities under South African or international law.
4. User Content & Sensitive Information
- Ownership: You own all client data, pet records, bookings, invoices, and notes you create within the Service.
- Prohibited Sensitive Data: You are strictly prohibited from storing unencrypted, high-risk data such as full credit card numbers, CVV codes, or government ID numbers within client or pet records.
- Pet & Client Information: Client addresses, contact details, and pet medical or health notes are stored at your own discretion and risk. Gecko Grid (Pty) Ltd is not liable for any data breaches or losses resulting from your decision to store sensitive information in plain text.
5. Service Availability & Maintenance
- "As-Is" Basis: The Service is provided "as is." We do not guarantee 100% uptime.
- Maintenance: We reserve the right to take the Service offline for scheduled maintenance. We will strive to provide advance notice for significant downtime.
- Third-Party Failures: We are not responsible for service interruptions caused by our third-party providers (e.g., Supabase, Paddle, or cloud infrastructure providers).
6. Data Portability & Deletion
- Export: You have the right to export your data at any time through the tools provided within the app.
- Deletion: Upon account cancellation, your data may be retained for a grace period before being permanently deleted from our active databases.
7. Intellectual Property
All software code, "GroomWave" branding, and visual assets are the exclusive property of Gecko Grid (Pty) Ltd. Your subscription grants you a limited, non-transferable license to use the software, not to own or modify it.
8. Limitation of Liability
To the maximum extent permitted by law, Gecko Grid (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits). Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be settled in the courts of South Africa.
