Welcome to GroomWave! These Terms of Use ("Terms") govern your access to and use of the GroomWave website and software (the "Service"), owned and operated by Gecko Grid (Pty) Ltd ("Company," "Gecko Grid," "we," "us," or "our"), a private company registered in the Republic of South Africa.
1. Description of Service & Eligibility
GroomWave is a client and booking management platform designed for pet groomers and mobile pet groomers. The Service allows you to manage clients, pets, bookings, recurring schedules, invoicing, and operational units/vehicles. By using the Service, you represent that you are at least 18 years of age or have legal parental consent.
2. Subscriptions & Billing
- Base Plan: GroomWave is offered as a single paid base plan. We do not offer a free tier.
- Add-ons: Additional features, such as extra units/vehicles, are available as paid add-ons on top of the base plan. GroomWave may introduce additional add-ons in the future, which will also be sold on top of the base plan.
- Free Trial: New users may start with a 14-day free trial. If no paid subscription is active at the end of the trial, access to the Service will be suspended until a paid subscription is started.
- Merchant of Record: All payments are handled by Paddle. By subscribing, you agree to Paddle's terms.
- Refunds: Refund requests are handled according to our Refund Policy and Paddle's standard policies.
3. Fair Use & Prohibited Conduct
To ensure a high-quality experience for all users, you agree not to:
- Use bots, crawlers, or scripts to access or "scrape" the Service.
- Use GroomWave as a remote storage or file-hosting service for large, non-business-related files.
- Attempt to bypass any usage limits associated with your tier (e.g., creating multiple free accounts to circumvent plan restrictions).
- Use the Service for any illegal activities under South African or international law.
4. User Content & Sensitive Information
- Ownership: You own all client data, pet records, bookings, invoices, and notes you create within the Service.
- Prohibited Sensitive Data: You are strictly prohibited from storing unencrypted, high-risk data such as full credit card numbers, CVV codes, or government ID numbers within client or pet records.
- Pet & Client Information: Client addresses, contact details, and pet medical or health notes are stored at your own discretion and risk. Gecko Grid (Pty) Ltd is not liable for any data breaches or losses resulting from your decision to store sensitive information in plain text.
- Privacy Policy: Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
5. Service Availability & Maintenance
- Early Access & Beta Status: GroomWave is currently in an "Early Access" phase. We are rapidly iterating based on user feedback to build the best possible tool for the grooming industry.
- Nature of the Service: During this phase, you may encounter occasional bugs or performance dips. While we do not offer a 100% uptime guarantee, our team works to resolve issues as they arise.
- Your Feedback: By participating in the Early Access phase, you agree that we may use your feedback and suggestions to improve the platform without any obligation to compensate you.
- Evolution of Features: We may add, move, or refine features frequently. We will aim to communicate major changes so your business is not disrupted, but we appreciate your flexibility as the platform grows.
- Maintenance: We reserve the right to take the Service offline for scheduled maintenance. We will strive to provide advance notice for significant downtime.
- Ongoing Improvements: We are constantly working to improve GroomWave. As a result, we may update features or adjust parts of the Service to better serve our users. While we aim to provide plenty of notice for significant changes, we reserve the right to modify or pause specific features to ensure the security and performance of the platform.
- Third-Party Failures: We are not responsible for service interruptions caused by our third-party providers (e.g., Supabase, Paddle, or cloud infrastructure providers).
6. Data Portability & Deletion
- Export: You are solely responsible for exporting your client records, bookings, and invoices for tax and legal compliance. You can do this at any time using the export tools provided within the Service.
- Account Deletion: Upon account cancellation, all user-generated data (including invoices between you and your clients) will be permanently deleted after a 30-day grace period. Gecko Grid (Pty) Ltd does not offer long-term archival services for cancelled accounts. It is your responsibility to ensure you have saved all necessary records required by your local tax authorities before closing your account.
7. Intellectual Property
All software code, "GroomWave" branding, and visual assets are the exclusive property of Gecko Grid (Pty) Ltd. Your subscription grants you a limited, non-transferable license to use the software, not to own or modify it.
8. Limitation of Liability
To the maximum extent permitted by law, Gecko Grid (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits). Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be settled in the courts of South Africa.
